Our partner Ernst Heitland GmbH & Co. KG based in Solingen, Germany was able to successfully defend a patent dispute against Diehl Metering GmbH based in Nürnberg, Germany. The district court dismissed the Diehl Metering lawsuit and the allegation of patent (EP 1,493,998 from 2004) infringement.
Back in the day, Diehl Metering asserted that an ultrasonic mirror holder extension according to the Diehl Metering patent had been implemented in Qalcosonic W1 to achieve a certain effect. The district court did not follow the dispute on this asserted point.
This court ruling delivers a strong message to the market that companies should compete with technological advantages rather than try to constrain smaller competitors with highly questionable legal processes.
